Scope and Application

The Privacy Policy governs your information collected by us from our website, mobile applications and offline activities such as mailings, telephone or in person owned, operated, provided, or made available by the us and your use of interactive features or downloads that we own and control (collectively referenced as the “ information or data."

(1.1) When you register an account with us by creating a user profile you are required to provide your personal details such as Name, Age, Gender, Address, Country, Pin code, Password, Mobile Phone Number, Email address and Preferred Language.

(1.2) In addition, we and our channel partners may use various technologies that automatically collect certain information whenever you visit or interact with the Services. This Information may include the browser that you are using, the URL that referred you to our Services, all of the areas within our Services that you visit, and the time of day, among other information. We may use this Information for a variety of purpose including enhancing or otherwise improving the Services.

(2) Log Information

When you access and use our services, information stored in the log servers which includes your Internet Protocol address, MAC Address, pattern of usage of our Services, contact numbers, time, duration and date of calls, information relating to the device such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL and cookies are collected.

We collect information about your location data through the Internet Protocol address of devices used by you and third party service providers/drivers to communicate with each other through our Services.

We collect information relating to each ride availed through our services including the pickup and drop location, traveling route, distance, duration, fare charged, fare paid, mode of payment. We may also collect necessary data to process your payment if you use our Services such as your credit/debit card number and the security code associated with your credit/debit card.

(6) We may share your personal information to various merchant establishments who will redeem your loyalty points availed under Customer Loyalty Programme conducted by us from time to time at our sole discretion.

We cannot, however, ensure or warrant the security of any information you transmit to us and you do so at your own risk. In addition, when you see or interact with these tools or content through our applications or view our web page containing them, some information from your browser may automatically be sent to the third parties. 9. Force Majeure

UTOO shall not in any circumstances whatsoever be liable to you for any delay or failure to fulfill its obligations under this Privacy Policy where any such delay or failure is caused in whole or in part by Force Majeure Event. Force Majeure Event shall mean any event that is beyond our reasonable control and shall include, without limitation, sabotage, fire, flood, explosion, acts of god, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, technology failure.

You hereby grant us your express consent to collect, store, use, analyze and share the information relating to you and your access to our Services

11. Governing Law and Jurisdiction:

This privacy policy shall be governed by and construed in accordance with laws of India. In the event of any dispute or differences arising out of or in connection with this privacy Policy between the Parties concerning their rights and obligations under this Privacy Policy, the Parties shall use their best efforts to resolve such dispute or difference amicably by discussion and mutual accord. If the dispute or difference cannot be resolved amicably within thirty (30) days, then the same shall be referred to Arbitration by a Sole Arbitrator who shall be appointed by UTOO. The seat of Arbitration shall be at Chennai and the Award passed by the Sole Arbitrator shall be final and binding. The Courts at Chennai alone shall have exclusive jurisdiction to try and settle all disputes.
